Peter Syregelas Wins Appeal in Auto Liability Coverage Dispute
Peter Syregelas defended a summary judgment he obtained in the circuit court of Cook County which found that an insured’s vehicle was not covered under her insurance policy and the insurer did not have a duty to defend or indemnify her for damage she caused to another vehicle.
Peter fended off arguments that his client waived its coverage position by issuing a denial of coverage prior to filing a declaratory judgment action, that the insurer agreed to reform the policy to provide coverage by issuing new insurance cards once a change request to add the vehicle was made (post-incident), that the insurer abused process by filing a declaratory judgment action rather than waiting to be sued by the insured, and that the carrier violated Illinois’s minimum liability requirements by denying coverage.
