Peter Syregelas Earns Summary Judgment (Again) in a CGL Coverage Dispute Related to a BIPA Class Action
Last month, Peter Syregelas won summary judgment on behalf of a firm insurer client after a long dispute with our client’s insured regarding coverage for an underlying class action alleging employer violations of Illinois’s Biometric Information Protection Act (“BIPA”). The case was briefed over two years ago, but decision was delayed due to the retirement of the sitting judge.
Following the assignment of Judge Lynn Weaver Boyle to the case, Peter aggressively pursued judgment by filing various notices of new decisions supportive of our client’s position. The Court applied the exclusion for Recording and Distribution of Material or Information in Violation of Law and found no duty to defend or indemnify our client’s insured.
The ruling adds to our stable of favorable results in this arena and will serve our clients well for future cases. Syregelas in particular has produced outstanding outcomes in this emerging area of law and is a true expert at litigating coverage disputes related to BIPA.
